The Indiana's Child Protective Services (CPS), offers a service to prevent out-home placement, and assistance to rejoin children with their families in situations where the children can return home (Indiana, 2015). This service is good, if the parents are able to resume the responsibility of taking care of their children.

When the counselor is not sure how to act or say about an issue, it is important that she goes back and review the ACA and NAADAC code of ethics to make sure she is not being biased or discriminating a client in her practice. ACA and NAADAC is a guide that will help the counselor to reference.
A state that undertakes custody of a child is declaring that it can do a better job providing protection. This system is a powerful agent of support, providing positive nurturing environments that enable a child to reach his or her potential. Nonetheless, when children suffer additional abuse in the system, this government intervention should be questioned.
If any professional becomes concerned that a child might be at risk of abuse, be it physical, sexual, emotional or neglect, it is their legal duty to pass on such concerns to the appropriate professionals who can assess if and what action should be taken. In cases where it will not put the child at greater risk or danger, the parents / carers of the child will be informed that such action has been taken.
Child abuse has been a big issue in the world for a long time. There has not always been child protective services like there is now. Children would be abused and neglected and nothing was being done because it was not being reported. The New York Society for the Prevention of Cruelty to Children was the world’s first organization in the late 1800s which was dedicated totally to child protection (Myers, 2008).
According to the ethical and legal principles of the counseling profession, it is our morally professional responsibility to break confidentiality in order to eliminate the possibilities of chaos, to the best of our ability. The American Counseling Association (ACA) code of ethics explains adherence to confidentiality in a number of instances. In standard A.2.e., Mandated Clients, it describes the requirements for informing mandated clients of the limitations to confidentiality and, should an issue arise, to whom the revealed information must be shared with. This rule applies to all clients. The counselor’s responsibility to do so must be conveyed to the clients at the very beginning of the counseling relationship, with periodic reminders throughout sessions, and include the dangers involved if the client refuses to participate in the mandated sessions. ACA code of ethics further explains in standard B.1.c., Respect for Confidentiality, that counselors are to guard “confidential information” and “disclose” this “information only with appropriate consent or with sound legal or ethical jurisdiction.” Therapists must also “identify situations” where breaches can void or challenge confidentiality (ACA, 2014, B.1.d., p. 7).
This paper is a response to a video discussing the issues of confidentiality, privilege, reporting, and duty to warn. This paper looks at these issues and their explanations in the American Counseling Association Code of Ethics as well as the Georgia State Board of Professional Counselor’s ethical guidelines and provides a commentary on the laws. It was found that these issues are not always black and white, but there is some debate on these issues. Confidentiality is both an ethical and a legal responsibility yet there are often times when the ethical demands clash with the legal demands. This paper explores some of those crashes and explains what I have learned from the video and the professional and stage guidelines concerning confidentiality and its implications and how I will apply what I have learned into future practice.
When a child is suspected of being abused, neglected or placed at imminent risk of serious harm by a member of the staff of a private or public school or an institution that cares for the child, the person in charge of the school or facility must notify the child’s parent or other person responsible for the child’s care that a report has been made. The state’s department of child abuse responsibility is to notify the head of a facility, school or establishment that a report has been made.
The 2014 ACA Code of Ethics provides structure that protects clients. Responsibilities that counselors to be aware of is avoid imposing their own values, attitudes and beliefs on clients (Ethics, 2014). Developing a relationship with clients requires providing counseling in a culturally sensitive manner (Ethics, 2014). Counselors respect the diversity of clients take measures to ensure that they are not of risk of imposing their values onto clients (Ethics, 2014).
In conclusion as I mentioned before counselors must remain confidential in all aspects of their job including testing and assessment. The ASCA and ACA provide codes of ethics to follow. Counselors should follow these code of ethics to prevent misuse of test, releasing client information and many more. Now that we live in an era where technology is advanced school counselors must be mindful to ensure that their clients information will remain confidential. There are numerous of assessments that require proper training before administering. Counselors must be competent in an assessment before they can administer it. It is up to counselor to determine of they are competent enough to administer a test but there are sources that can help a counselor
Child Protective Services (CPS) is a complex system of assessments, investigations, and conclusions. CPS is the central agency in each communities child abuse and neglect service system. It is responsible for ensuring that preventative, investigative, and treatment services are available to children and families endangered by child abuse and neglect. As a result, CPS workers must perform a variety of functions when responding to situations of child maltreatment and play a variety of roles throughout their involvement with child protective clients. While looking at the dangers and environment in a child’s home, advocates such as employees of the Department of Family and Protective Services of the State of Texas, have the moral obligation to take into consideration safety of children shelters and foster homes. Morally, advocates for the children should also take into consideration the psychological trauma that the child may or may not experience through being taken away from family and being placed, possibly multiple times, at new places away from everything they know.
Although the federal government controls the funding that will enhance the family relationship by supplying services, this unfortunately does not always rectify the family situation. If the system in place doesn’t work and the parent isn’t ready to have the child returned, this will leave a negative impact on the parent-child relationship. The parent may become frustrated and resort to behaviors such as substance abuse, physical abuse, and verbal abuse jeopardizing the parent-child relationship. As stated in Foster Care at issue, by Debra Bloom, family reunification is less likely to occur when parents are involved in the correctional system. Reporting that 16 % of mothers with children in foster care are arrested within 18 months, with the arrest occurring after the child has been placed in foster care. Suggesting that child welfare look beyond the system when developing potential outcomes.
There are multiple precautions and/or practices that private practitioners can adopt that will minimize their liability, while also promoting the best possible practice and therapy for their clients. Following the Code of Ethics, while maintaining current educational and supervision practices also help.
Child maltreatment is a widespread issue that affects thousands of children every year. There are four common types of child maltreatment; sexual abuse, physical abuse, emotional abuse and neglect. All of these types of abuse are very serious and can have many consequences for the children and families. The most common consequence of severe child maltreatment is the removal of that child from their home (Benbenishty, Segev, Surkis, and Elias, 2002). Most social workers trying to determine the likelihood of removal evaluate the type and severity of abuse, as well as the child’s relationship with their parents (Benbenishty et al., 2002). At this point as a student, I believe I have a firm grasp on the foundations of the ACA Code of Ethics. The ACA Code of Ethics is organized for several valuable reasons. The ACA Code of Ethics serves the community, the members of the ACA, and helping professionals (CASEBOOK). The ACA Code of Ethics was created to protect and promote the wellness of the community, educate members of the helping profession and community, improve the practice of helping professionals, and protect the clients and the practitioners (LEGAL). The approach the ACA Code of Ethics uses is holding health professionals accountable for their clients. This allows clients to be protected and to be counseled in a safe and non-judgmental environment. There are five core values the ACA holds for all helping professionals. The first is enhancing growth and development for clients. The second core value is brining awareness to diversity and multicultural views. Third value is to promote social justice. Fourth value is building integrity and trust with the client. The last core value is practicing in an ethical manner (CASEBOOK). I understand the reason behind the ACA Code of Ethics, however I hope this class will teach me more about the individual codes.
