The proposed solution is to urge the federal and state governments to step in and fill the gap that the private sector has neglected to fill with regards to jobs for economically marginalized black people. They are proposing a $2-4 trillion investment in a federal program to create jobs for black workers and to incentivize more companies to hire them by supporting businesses that already do by giving them tax credit. This solution would also include a Ban the Box legislation for formerly incarcerated people by making it illegal to discriminate against workers with a criminal history, thus allowing them to have jobs as well.

One of the primary problems in Kentucky is the unemployment rate of people with criminal backgrounds that caused the use of 'ban the box’ by employers in all but one city in Kentucky and among many other states. Former inmates often face restrictions in different situations that may include housing, voting and employment (Hoskins, 2014). The problem does not affect only those people in Kentucky, but also other states in the United States and even in other countries. The majority of the employers show reluctance to absorb people who have criminal records. Some of the studies show that more than half of the employers will discriminate an individual due to their incarceration records (NIJ, 2013). Even in a situation that they find employment,
“Some employers used tests for hiring or promotion that screened out African American at a higher rate than white applicants, making it nearly impossible for them to be hired in any substantial numbers” (Vertreace, 2010). In many cases white supervisors or managers would make sure they interview just enough minorities so they want to appear not to be bias toward other races. They even pretend to follow company’s rules, but instead they make their own rules and dare someone to cross them. Nevertheless, there are not enough opportunities for black people to advance. If the only available jobs are low-income jobs, then the chance of living in poverty will continue for minorities.
The main purpose of the goals was to put a stop to hiring illegal immigrants. The act itself makes it unlawful to hire anyone that is not a documented citizen of the United States. More than ever, the law provides for employer sanctions and penalties if the law is violated. According to Nichols, they felt the new policy was very democratic because it brought along penalty for employers who were hiring illegal immigrants. As the policy relates to values of the social work profession they are consistent. Social workers are always making sure all immigrants are United States citizens so that they can avoid deportation and so they can also receive all financial assistance they might need.

Ban the Box or Fair Chance Policy is a policy currently in the works for ending the discrimination of ex-convicts and ex-felons when seeking employment due to their criminal history. This policy gives previously and recently released ex-convicts and ex-felons the chance to achieve a long lasting stable employment. It gives the recently increased for the employers consider a job candidate’s qualifications first, without the stigma of a criminal record. This policy touch on the bases on the individuals being released from correctional institutions. This policy is trying to address the social problem of employment discrimination of ex-convicts and ex-felons. This policy focus are the individuals who are either recently released from prison or jail and individuals who have been out of prison or jail who are struggling to achieve stable implement but cannot due to criminal history. Currently this policy is being implemented in 23 states: California, Colorado, Connecticut, Delaware, Georgia, Hawaii, Illinois, Louisiana, Maryland, Massachusetts. Minnesota, Missouri, Nebraska, New Jersey, New Mexico, New York, Ohio, Oklahoma, Oregon, Rhode Island, Tennessee, Vermont, Virginia, and Wisconsin. Florida has not yet joined. I believe that Ban the Box should become a federal law where all 50 U.S. states must abide by this policy once the law is enacted.
Researchers found a substantial amount of diversity in the types of criminal record questions asked on applications. Although standardized questions about felonies were common, a sizeable proportion of employers asked no question at all (22%) and half questioned a lesser offense in addition to a felony (51%). The latter questions about lesser offenses ranged across a diverse set of severity levels, such that a large percentage of the population would be required to answer truthfully. Although rare, some applications, even asked about the arrests, past and pending charges, or included vague phrasing (“for which a jail sentence could have been imposed”). A full 16% of felony questions and 39% of lesser offense, questions included no time limit, so those who were ever convicted would face a permanent obligation to answer affirmatively when seeking positions with these employers. With less than 1% of applications specifying adult crimes only, applicants were left to their own discretion in deciding whether to divulge juvenile records.
In addition, the BLM need for social action is to exploit the anti-black racism, to drive for black people’s rights to live with self-worth and veneration and be incorporated in the American democracy that they helped generate. Altman, Rhodan, and Frizell (2015) explain that “We must recognize the effects of hundreds of years of discrimination. We must challenge our government, our institutions, our police forces, our criminal justice system, our corporations, and our schools and universities to constantly examine their policies to promote diversity and inclusion, to call out discrimination and reduce implicit bias” (p. 120). For instance, affirmative action can help a black individual either get a job or help a student get into college. If an employer is indecisive about choosing to hire a black individual or another person who has the same experience, possibly even more, the employer can be forced to hire the black individual because they have to meet a quota. Researchers have scrutinized that employers have asked about criminal records in a variety of ways. Approximately 22% of the employers visited during the audit did not include a criminal record question on their application (17%) or did not use applications (resume only, 5%). Among the 78% of employers that did include a criminal record question, the question language and context varied greatly, as did the offense severity level. Approximately 27% of employers asked about felony convictions only, whereas 51% asked about lesser offenses. Within the categories of felony only and lesser offense, researchers organized questions from the most to least inclusive. For felonies, the questions were uncomplicated, with 16% of all applications simply asking, “Have you been convicted of a felony?” An additional 11% of applications included a time limit on how recently the felony occurred, ranging between two to five years.

The American workforce receives many of these same laws that directly effect employment statuses. These protection laws cover many different groups. However, even with current laws in place, there are still marginalized groups that have little protection under the current system. To complicate this matter, there are changing demographics in America, which is causing the workforce to become more diverse. The current employee protection and nondiscrimination laws are essential to the current workforce and going forward these laws will need expanded to encompass unprotected groups in a more diversified America.
