On December 7, 2016, Investigator Sergeant Martin Marler contacted me via phone and advised of an incident that he and Investigator Emmitt Reyer were involved in at 46th Street and Judy. I noted it was daylight with no rain. Sergeant Marler’s 2013 Dodge Durango (002RSN) was in good condition. The incident occurred on a two lane county road with a posted speed limit of 35mph. There was an AT&T telephone box damaged during the incident. Sergeant Marler’s vehicle was not damaged during the incident. The suspect’s vehicle exhibited extensive damage. The incident was not called out over the radio therefore the duration can only be estimated; approximately 1 minute. The incident covered a distance of approximately 1500 feet. Mr. Montgomery said he was in the area of Highway 161 driving , in his own words “stupidly”. Mr. Montgomery said he was attempting to catch his girlfriend cheating on him and he was in a hurry to do so and then return the vehicle he was driving to his mother. Mr. Montgomery said he had no reason to run stating that he knew he had no warrants and he was unaware of his ARDL being suspended. Mr. Montgomery said he was unaware that Sergeant Marler and Investigator Reyer were attempting to stop him and that he never remembered seeing blue lights. Mr. Montgomery said he could not get his vehicle to stop and believed it was a good idea to exit the vehicle while it was traveling down the roadway. Mr. Montgomery said he had no intentions of running from Sergeant Marler and Investigator Reyer, My investigation revealed that Sergeant Marler’s actions where within General Policy 04-003 Pursuit Driving-General. Though Sergeant Marler and Deputy Reyer’s actions did not violate policy, their actions where a violation of the Uniform Standards of Conduct 06-Committing Unsafe Acts or Endangering Self or Others.
