I attended a Board ordered deposition of Dr. Shital Shah in the above-referenced matter on 08/23/2017. The claimant was represented by attorney Nancy Flaherty and our hearing reporter was Linda Engel. As you know, this case has been established for an injury to the head as well as adjustment disorder with anxiety and depression. Prima facie medical evidence has been found for post concussive syndrome and post concussive headaches. The Judge recently found prima facie for a conversion disorder but we have not yet been directed to develop the record on that issue. At one point, Ms. Flherty tried to ask the doctor about post traumatic stress disorder but I objected to this, pointing out no prima facie medical evidence has been found for it. Ms. Flaherty ultimately withdrew her questioning along these lines. The doctor, having gone through all of her reports including the most recent on 08/21/17, indicated that the claimant was approved for physiological testing which she thought had been done at the Helen Hayes Hospital but she had not yet seen the report. She was then asked about degree of disability. She said she never really commented on it but she guessed it was 100% up until her last visit. She had no opinion as to her degree of disability thereafter but she released the claimant back to work doing half days two (2) days a week with restrictions of not being left alone in the classroom and limited computer time. On cross-examination I had the doctor confirm that not only did she not know the size of the child but she did not know the age of the child as well. She doesn’t know anything about the force with which the claimant was struck. I also had the doctor testify that the claimant was emotionally upset at the time of her first visit and that some of her findings, such as memory loss or ability to do a serial 7 test, could be due to her emotional upset. On this date and time this caseworker met with Latonya Myles for a follow up visit. At this time this caseworker observed Jacoreyn to be clean. healthy and adequately dressed. The marking cause by the fall on Jacoreyn forehead had fully healed and his skin has return to its normal color. The caseworker observed Jacoreyn walking and playing with his tablet along with his brother Jaylin. Ms. Myles reported that Jacoreyn head has heal well and she has not had any problems. Ms. Myles reported no concerns. Ms. Myles gave the caseworker permission to speak with her son Jaylin.

Borbely had physician appointment with his PCP Dr. Boggs and cardiac. Mr. Borbely declined surgery with cardiac physician. Medical records were requested from Henry Ford Hospital. Mr. Borbely had a neuropsychological testing and Dr. Kamoo is in the progress of contact his nephew for a review. I asked Dr. Ross if she knew why anyone would make such a complaint and she said she had her suspicions, but wouldn’t say since she couldn’t prove it. This causes an emotional as well as developmental change in Riley. The author is able to empathize with the character due to her own childhood experiences as an Army brat and having to frequently move, leaving friends behind, and as a parent in the military who had to frequently move her own children. She has first hand experience with the emotions an adolescent goes through as well as those of a parent who has to deal not only their own emotions, but with those of their child.
