Between 1700 and 1900 a system familiar to our eyes emerged as a result of important changes. The 1800s very harsh and a lot of crime was done in that time. The laws, punishment and jail were similar, also very different from today's. In the 1800s the punishment was much more survivor and stick to it more than now. If you lived back in that time, it was usual to walk the streets and you see a hanging happening. This showing the cruelty and none caring of the people and how harsh the punishment was.

According to statistical data found in the Bureau for Justice Records, there are a number of problems that most prisons in the country face. The records indicate that the number of adult federal and state inmates increased from `139% in `1980 to 260% (Walker, 1999). As a natural default, the United States of America has the highest incarceration rate in the world. This in itself brings about one of the major problems that are faced in modern incarceration which is overcrowding in most prison facilities. The number of offenders in the country has increased rapidly over time while the country prison system has not really been able to cope with this rapid increase. Prisons intended for one or two inmates are now crowded with more than fifty individuals. Because of this most prisons are overcrowded and most of the facilities available are unable to cater for the needs of all the prisoners (Siegel, 2009).

Ever since the first prison opened in the United States in 1790, incarceration has been the center of the nations criminal justice system. Over this 200 year period many creative alternatives to incarceration have been tried, and many at a much lower cost than imprisonment. It wasn’t until the late 1980’s when our criminal justice systems across the country began experiencing a problem with overcrowding of facilities. This problem forced lawmakers to develop new options for sentencing criminal offenders.

Change over time; that is a common theme with everything in the world. The concept of punishment is no different in that regard. In the 16th and 17th century the common view for punishing people was retaliation from the king and to be done in the town square. In what seemed to be all of a sudden, there was a change in human thinking, the concept of punishment changed to a more psychological approach compared to a public embarrassment/torture approach. The following paragraphs will discuss the development of prisons and what in fact gives people gives people the right to punish; as well as the overall meaning and function of prisons. Throughout the years, the use of imprisonment has varied, along with its influences of society. It is thought that although prisons have been around since the thirteenth century, prisons as we know them now to be have only been around for the last three centuries. The first uses of prisons were not seen as a form of punishment instead they were used as a way of making people do something. People would be held in prison until they paid their debts, or awaiting trial and then leading up to their sentence. McGowen (1995) suggests that from the early 1700s ‘bridewells’ a house of correction have existed, however at that time being used merely for vagrants and drunks. At the end of the sixteenth century there was a shift in punishment to imprisonment, along with this came a new, more humane idea of reform. Criminals would spend their days of prison carrying out hard labour. However after the American Revolution, imprisonment took a step back and there was another change. There was mass overcrowding within the prison service and although the death penalty was still being used it was a symbol of the power of the state. Therefore, an everyday way of dealing with offenders would be transportation to the colonies, being either Australia or America.

The delivery of punishment has changed significantly over the centuries. Up until the 19th century in England, imprisonment was not regarded as a punishment, it was merely used while the offender waited to be sentenced to their ‘real’ punishment (Bull, 2010; Hirst, 1998). Corporal punishment such as flogging, branding and mutilation, death by hanging, and transportation to other continents such as America and Australia were common punitive measures through the ages, until well into the 1800’s (Newburn, 2003). We can date the United States criminal justice policies all the way back to the 17th Century. Although it is nothing compared to what we have today, there have been improvements along the way. One of the major reform needed in our corrections system are the war on drugs and overcrowded prison. The history of corrections in the U.S. has been seen through four major eras known as the Penitentiary, Reformatory, Reintegration, and Retributive Era. Each era has tried to explore the best way to deal with people who have broken the law. Based on the ideas of each era, we’ll explore which reform needs to be implemented.

The United States is regarded as a country of innovation and progress. However, the prison and disciplinary systems in the U.S. fall short in several aspects. With the highest incarceration rate in the world, one might expect American prisons to be prepared for providing quality care and rehabilitation for inmates. Private prisons may seem beneficial at a glance; however, they enforce lax regulations and are notorious for overcrowding and “barbaric” conditions. In America, crime rates are going up and prisoners are being released from prison with a wrong sense of direction resulting in their finding themselves back behind bars within a short period of time after being released for an action that could have been prevented if the proper precautions had been taken. Prisons need to put forth the effort to resolve these issues and make America’s streets secure again. The criminal justice system in prisons is a rising concern in this country that is affecting many and it is time it was improved by reforming the inside of prisons, providing prisoners with more when released, and keeping them under surveillance after release to help ensure they will not return to prison, thus keeping crime at a lower rate.

In the 1970s and 1980s, a massive amount of inmates began fillin up the United States prison systems. This huge rate of growth in this short amount of time, has greatly contributed to the prison overcrowding that the United States faces today. In fact, the prisons are still filled to the seams. This enormous flood of inmates has made it practically impossible for prison officials to keep up with their facilities and supervise their inmates. American prison system incarceration was not officially used as the main form of punishment in United States (U.S.) until around the 1800’s. Before that time criminals were mainly punished by public shaming, which involved punishments such as being whipped, or branded (HL, 2015). In fact, President Lincoln codified the prison incarceration system in the Emancipation Proclamation that indicated no slavery would take place in America unless a person was duly convicted of a crime (paraphrased) (White, 2015). In this era prisons were used more as a place where criminals could be detained until their trial date if afforded such an opportunity. However, one of the main problems with this idea was the fact that the prisons were badly maintained, which resulted in many people contracting fatal diseases. Yet, according to White (2015) unethical and immoral medical experiments were also conducted on inmates’ leading to health failures. Moreover, because everyone was detained in the same prisons, adolescent offenders would have to share the same living space with adult felons, which became another serious problem in that adolescent were less mature and could not protect themselves in such environments

These measures were taken to ensure public safety but are now posing a problem for our correctional facilities. Overcrowding and budgets are among the problems brought about by these measures. Both the state and federal correctional population throughout the United States have steadily seen significant increases in their population, every year for the past decades. Based on the census found on the Bureau of Justice website, the data collected between June 30th 2000 to December 30th 2005 showed that prisoners held in custody between federal and state prisons increased by 10%. During the mid 1900s, many changes came about for the system of corrections in America. Once a new idea goes sour, a new one replaces it. Prisons shifted their focus from the punishment of offenders to the rehabilitation of offenders, then to the reentry into society, and back to incarceration. As times and the needs of the criminal justice system changed, new prison models were organized in hopes of lowering the crime rates in America.
