Criminal justice administration is wide and it entails law enforcement and the judicial administration. Some of the jobs that relate to criminal justice administration include; security coordination, juvenile delinquency administration, law enforcement and being a courtroom official. Additional crime is also part of criminal justice administration. This field entails terrorism prevention, immigration policies and social policies. Other duties that criminal justice entails include; police officer, community relations advocate and correctional officer. For an officer working with the criminal justice administration, his work involves law enforcement (Bharti, 2008). Key issues in Criminal Justice Administration today The criminal justice administration today faces various issues and problems thus needing serious reforms. In most cases, many nonviolent offenders go to jail because many prosecutors and district attorneys succumb to political pressure hence become tough on crime. The prisons are always populated and there are minimal resources to ensure there are significant improvements in the system. The criminal justice system is a set of organizations and procedures set up by governments to control wrongdoing and force punishments on the individuals who disregard the laws. The main frameworks are state and federal. The state criminal justice systems handle wrongdoings perpetrated inside their state limits and government, the federal criminal system handles violations carried out on federal property or in more than one state. This system is supposed to be equal yet the nature of offenses, differential policing policies and practices, sentencing laws and biases are possible contributors to disparities in the system. The severity of the offense, prior record, age and education level are also taking into account when a decision is being made. Our prison system today varies immensely with ascending numbers of minority groups jailed within the system. Racial and ethnic imbalances continue in the United States and no disparity is more evident than that found in the criminal justice system. Disparity usually refers to a difference that is unfair, disparity in the criminal justice system stems from racial disparity which concludes that the proportion of a racial ethnic group within the control of the system is greater than the population of that group outside that control.
The concept of providing basic healthcare services to individuals in need has undergone an agonizing transition, from a luxury once only afforded by the affluent to a basic human right granted to citizens of every economic station, and the recently enacted Affordable Care Act (ACA) was designed to finalize this ethical evolution. Reflecting perhaps the bitter political enmity currently consuming the nation's once cherished democratic process, Republican legislatures in states throughout the union have bristled at the ACA's primary provisions, threatening all manner of procedural protestation as they attempt to delay and derail the bill's eventual implementation. One of the most intriguing aspects of the sprawling, thousand page law, however, has been the stipulation that individual states will be given a choice to either accept federal funding to expand their statewide Medicaid roster, or to forfeit all federal funding for that program in perpetuity. The role of government in monitoring and regulating the healthcare industry has been long debated, and the bitterly contested passage of President Obama's ACA, a law aimed at revising the country's health insurance system through the creating of a federal health insurance exchange to facilitate increased competition among insurers, has rekindled the debate over who holds the ultimate responsibility for regulating the care provided by hospitals, community clinics, and private practices.
The American Criminal Justice System are sets of agencies and process made by the government to control crime and to penalize those who commit it. The justice system is different based one’s jurisdiction, meaning city, state, federal or tribal government or military installation. The Criminal System is divided into two main parts, the state and the federal. The state portion handles crimes within its state boundaries. The federal portion handles crime committed on Federal property or in two or more states (“Criminal Justice” 1). The American Criminal Justice System needs reform because of its emphasizes on incarceration punishment rather than Rehabilitation. Our justice system especially enforces punishment on blacks and Latinos resulting of overpopulation of prisons like Rikers Island for petty crimes. Also, another reform needed the juvenile cases. For example, juveniles who commit petty crimes shouldn’t be sent to adult prison and shouldn’t be near more dangerous and serious inmates.
The criminal justice system plays an important role in this society, it is meant to protect and serve. This “system” is also meant to maintain the peace and enforce the laws set by the government. However, the criminal justice system is not even close to perfect. It has many flaws, some of which are: police brutality, death penalty, mass incarceration, gun violence, and especially wrongful convictions. A majority of the flaws that the system has can be easily fixed and can be set straight. For example, the issue of wrongful convictions has been relevant for quite some time and has the potential to decrease its probability of occurring by focusing on the importance of scientific evidence, rid of faulty witness testimonies, and make sure that the lack of evidence and/or government misconduct, if applicable, does not determine the outcome of the case.
Criminal justice practitioners are necessary for a civilized society. Without those who form boundaries to our freedom, and the ones that reinforce those laws, our community would be chaos. Some of the main social issues our society faces are drug abuse, gang violence, child abuse, and terrorism. The criminal justice practitioners face these types of issues daily. These professionals must act on the morals and laws stated by society rather than their own opinions, sometimes facing hard decisions. The criminal justice field is always active and busy, dealing with countless amount of criminal activity throughout the country.
Within the criminal justice system, officials abuse their power. The officials of the justice system have a duty to protect and perform their duties with unbiased decision making. The abuse of power jeopardizes people’s lives who are not able to sustain oneself and their families. Some people do not understand that poorer people find themselves in jail more and once a person is released, that person is subjected to return to jail for the amount of money owed to the state. There are many obstacles for the poor, especially those of color. People of color are treated unfairly in the justice system, from the arrest, the sentencing, and the release. The criminal justice system is supposed to be just but that is not the case. The criminal justice system allows for the police, public defenders, and judges to bend the laws and not be punished for their actions or that apologizes can fix the wrong that has been done. This paper will discuss the abuse of power from the justice system and the solutions to rectify the damages.
The problems surrounding the criminal justice system range from a variety of issues in different areas of the system. But i believe they are all connected back to a societal problem, that has to do with a outdated philosophical notion “redemptive violence”. I will break down each aspect, which i find most troubling. I will cover problems between policing and peacekeeping, corrections options, and the issue of redemptive violence which is a major issue in the philosophy of the criminal justice system. These issues represent problems that have always been key topics when discussing problems of ethics in criminal justice. Policing and Peacekeeping are roles that have long been debated in usefulness to stopping crime. Corrections comes with the reality of incarceration having little chance of success but more likely a higher rate of recidivism. I well also touch on briefly the issues of attorney discretion. While the issue of redemptive violence ties them all in, As i well show this philosophy is the “root of all evil” in the issues facing the criminal justice system.
The Justice system seeks to prevent crimes and to capture those who have committed crimes. But what are the causes of crime, maybe poverty, or greed, or is sometimes caused by the system. Is the risk worth the reward and is reward the worth risking the punishment? Power and influence is threaded deeply into the Criminal Justice System. Are all offenders caught and processed with the same demeanor and given the same punishment? The system needs to be impartial to all offenders regardless of the offender’s social position, job or yearly income. The general punishment for most crimes is incarceration in most states with a difference in duration to adjust per each crime. This is the deterrent against crime. This is what should be keeping
Part 1 of the book highlights chapter 1 and 2, which talks about politics and the consequences of incarceration while chapter 2 talks about the politics of being punished within the united states, some sub topics between chapter 1 and 2 include problem ownership, philosophies, historic changes with the corrections policy throughout time and the economic impact of being incarcerated. Chapter 2 talks about the process in which politics can affect the outcome on crime and punishment, throughout the 1960s the criminal justice system has changed a lot especially correctional professionals who have brought issues to crime and its political forefront.
Chapter 9 focuses on special topics, which reviews the five present and controversial issue in the criminal justice system. Out of all 5 of these issues I think that the use of confidential informants in war on drug is the most harmful to our nation’s correctional system and should be eliminated. The reason I think that the use of confidential informants should be eliminated drug war on drugs is because the use of CI’s frequently have negative consequence on the war on drugs (Austin & Irwin, 2012). The first example, is that CI’s are not appropriately screened and supervised, which causes innocent individuals to be arrest. Every time an innocent person is exonerated based on DNA testing, law enforcement agencies look at what caused the wrongful convictions. There are many issues that contribute to putting guiltless lives behind bars including: eyewitness misidentification, false confessions, imperfect forensic science, and more (Gould and Leo 18). When a witness is taken into a police station to identify a suspect, it is easy for their memories to be blurred and their judgment influenced. This can lead the witness to identify a suspect who is actually innocent. Flawed forensic science practice also contributes to wrongful imprisonments. This research paper discusses the issues of people who suffer from mental illness being placed in jails instead of receiving the necessary treatment they need. The number of inmates serving time in jail or prison who suffer from mental illness continues to rise. In 2015 the Bureau of Justice reported that sixty five percent of state prisoners and fourth five percent of federal prisoners suffered from mental conditions such as bipolar disorder and schizophrenia. Individuals who suffer from these problems require special mental health treatment for their needs to be met. Many of our prisons and jails lack the necessary resources to care for these inmates and because of that inmates who do not receive the treatment they need are at a higher risk of becoming a repeat offender. Despite the research and findings that show that the criminal justice system is unable to deal with issues dealing with the mentally ill there has been limited solutions put in place. Given the challenges the criminal justice system faces it is important to address the problem and come up with better solutions. This research paper will discuss the various techniques and solutions that scholars have propped and their effect on the issue of mentally ill criminals and how the criminal justice system should approach the problem.
This chapter provides insight on controversial issues troubling the criminal justice system, such as the use of confidential informants, three strikes laws, life without parole, and sex offenders, which is no doubt relative to prison overcrowding in the United States. The most question raised is which issue has been the most detrimental to this nation and should be eradicated immediately?
For years and years the government has discussed the issue of the criminal justice correctional system. Major topics include overcrowding, financial strain, and recidivism. Correctional facilities and agencies should recognize the different types of offenders they house and reexamine their living arrangements in order to prevent overpopulation, save money, and most importantly, decrease recidivism. This paper examines how properly managing male, female, pregnant, and elderly inmates can be a solution to a lot of the correctional systems current problems. Also discussed are the reasons why people choose to commit crimes. The general strain theory has been a well-known approach to understanding the cause of crime. Another reason why people commit crimes is because jail is the only life most people know and a majority feel that life is prison is easier than what they would have to deal with on the outside. A closer look at employment in society shows how offenders need more support on the outside to become a law abiding citizens and stay out of the prison system. Providing inmates with the resources to succeed is not actually increasing their odds of succeeding.
The criminal justice system is a group of institutions that work together to protect a society, prevent and control crime, and maintain justice; enforcing the laws regulated by society. As the years have gone by and society has evolved; so have the criminal justice system and its methods to accomplish its role in society. This short analysis will evaluate the main facts that have been affecting the criminal justice system for decades and have influenced the evolution the justice system is enduring in a changing society (Muraski, 2009). Amongst the changes in the system, we will discuss the effect the changes have had on the citizens and how their perceptions have evolved as well.
