Sexual Orientation Discrimination Everyone agrees that workplace discrimination has no place in the modern business world. But not everyone understands the laws that protect employees against discrimination. In this case, what you don’t know can hurt you, especially if an aggrieved employee files a discrimination claim. Definition According to an article published by Workplace Fairness, a non-profit organization that provides information and education on employee rights, sexual orientation discrimination means treating someone differently solely because of his or her sexual orientation whether it be homosexual, bisexual, or heterosexual. This discrimination may occur because of a perception of someone whether the perception is right or wrong. Someone who is discriminated against on the basis of sexual orientation may also be discriminated against or harassed on the basis of sex, gender identity, disability, such as actual or perceived HIV status, and/or marital status. This is very important to Human Resource Professionals because they are the ones that make sure organization objectives are being met, and policies are being followed. It is the Human Resource professionals that deal with staffing, compensation, safety and health, training and development as well as employee and labor relations issues. Workplace discrimination takes place when an employee is hostilely discriminated against for one or more reasons, including gender, religion, age, sexual orientation, ethnicity or race. Per the Equal Employment Opportunity Commission, racial discrimination comprises of treating a job candidate or employee negatively because they are of a certain ethnicity or because of particular features linked with their race, such as hair texture, facial features or skin color. While the law forbids workplace harassment and discrimination in all facets of employment, from hiring and training to raises and layoffs, the EEOC still reports thousands of claims a year. One such claim was filed by the EEOC in the U.S. District Court of Minnesota against Alliant Techsystems (ATK), on behalf of Tyeastia Green.
Expressing dislike or hatred towards a group or individual based on sexual orientation shows little to no compassion or understanding to what they might be going through themselves. It is important that employers know what constitutes discrimination based
Infringement of people's rights because of their race, sex, age, marital status, sexual orientation is a common phenomenon. This phenomenon contradicts the eternal aspirations of humanity to freedom, equality, and justice. In labor relations, the most important rights that affected are the right to equal access to work, equal pay for equal work, equal chances of promotion, protection from unemployment, etc. Therefore, it is so important to talk about discrimination in labor relations, and not only talk, but look for ways to protect those categories of citizens who are discriminated against.
Employment discrimination can wear many faces in the workplace. Three common workplace discriminations are in the categories of age, weight, and sexual orientation. Only age discrimination has a specific law named after it. The law is called the Age Discrimination Act (ADA). Weight discrimination is linked with the Americans with Disabilities Act in order to be enforced. Sexual orientation (Gender identity) is linked with the Civil Rights Act of 1964. There is a new regulation called the LGBT employment discrimination in the United States, but the enforcement of this regulation will vary by the jurisdiction. It is paramount that workers be aware of the overview of these three different types of discrimination in the workplace. Workers
Discrimination is a complex issue that affects everyone. It involves all races, sexes and religions. Subtle discrimination exists in the workplace, whether people want to accept it or not. Recognizing this fact is the key to overcoming the obstacles of cultural differences and to successfully integrating all levels of the corporate world.
Under federal anti-discrimination law an employer, regardless of their size, may be legally responsible for any misconduct on the part of its employee unless and unless it can be show and prove that ‘all reasonable steps’ have already been taken to ensure the reduction of this liability.

“And each of us can practice rights ourselves, treating each other without discrimination, respecting each other’s rights or dignities” (Carol Bellamy). In today’s economy, being bias in the workplace is more than a distraction, it is costly. It is hurting people of different race, ethnicity, age, sex, religion, and more. Working to stop inequality is something that needs to happen. While some may say that unfairness helps the economy and puts everyone in the right place, discrimination is prevalent in world history, and definitely affects the workplaces in the economy and their workers.
Since women obtained their rights, they have struggled to earn the same respect as men in the work area. Women do not earn the same amount of money as men do, and are more likely to not get the job or the same respect as a man in the industry. In addition, people have also discriminate women’s sexuality; plenty of people have being denied the job due to their sexual orientation. It was not till 2003 when the Lesbian, Gay, Bisexual, Transgender and Queer community (LGBTQ) were protected by law from discrimination. Throughout the last few years people have gotten the opportunity to live openly regarding their sexual identity, as some governments’ have permitted LGBTQ marriage people started being more openly about their sexuality. Being part of the LGBTQ can affect the job people may get and how people treats the LGBTQ community in their jobs. Now days, people still get discriminated on their workplace for their sexual orientation making it hard for them to feel comfortable in their workplace, women mostly get sexually and verbally assaulted by co-workers.
What exactly is discrimination? How does it affect the workplace? Who does it affect? These questions carry a distinct meaning to them asking what discrimination is and does to the workplace environment. “Discrimination can be defined as a less favorable treatment towards an individual or a group of individuals at work, usually based on their nationality, religion, skin color, sex, marital status, age, trade union activity, or other defining attributes (Academic Help ,n.d.).” Workplace discrimination can take more open and threatening forms, namely known as workplace harassment. Discrimination occurs when an employee is made to feel slightly or fully intimidated to gain their sense of feelings, insulted to be ridiculed, or humiliated leading to unnecessary problems in the workplace.
The dictionary defines discrimination as the unjust or prejudicial treatment of different categories of people or things, especially on the grounds of race, age, or identified sex and sexual orientation. The term LGBT stands for, lesbian, gay, bisexual and transgender. These terms refer to sexual orientation and also gender identity. Every day people of the LGBT community suffer wrongful terminations and oppression in their schools for their sexual orientation or identified gender.
Throughout history there have been numerous legal cases and issues relating to the LGBT community involving workplace equality. One topic that has recently been a popular issue would be the employment rights for LGBT individuals. Equal treatment in the workplace and not being discriminated against for your sexual identity or sexual orientation is extremely important in today’s society. During these past couple of decades our government has worked hard in trying to pass certain laws that are supposed to protect the LGBT community when it comes to being employed and not allowing businesses to discriminate against someone for their sexual identity. However, that is not always the case and businesses still find ways around these laws or certain states will try to surpass these laws.
